Domain Name Purchase Agreement — the terms governing every
sale and transfer of a domain name through Domainster.
This Domain Name Purchase Agreement ("Agreement") is entered into between Domainster ("Seller") and the Purchaser ("Buyer"), collectively referred to as the "Parties", and governs the sale and transfer of the domain name identified above (the "Domain").
Buyer agrees to pay the total purchase price in full at the time of this transaction. Payment will be processed via a secure third-party payment processor. All amounts are in US dollars unless otherwise specified. Domainster does not store full credit card numbers on its servers.
Upon successful payment, Seller will initiate the transfer of the Domain to Buyer's nominated registrar account within seven (7) business days. Buyer is responsible for providing accurate registrar and account information and ensuring their receiving account is capable of accepting incoming domain transfers.
All sales are final. Domain name purchases are non-refundable once the transfer process has been initiated. In the rare event that Seller is unable to complete the transfer due to reasons within Seller's control, a full refund will be issued to the original payment method.
Seller represents that, to the best of Seller's knowledge, Seller has the legal right to sell the Domain and that the Domain is free of liens and encumbrances. Seller makes no warranty regarding the commercial value, trademark suitability, or future performance of the Domain.
Buyer acknowledges that Buyer is responsible for ensuring the Domain does not infringe upon any third-party trademarks or intellectual property rights prior to completing this purchase. Domainster makes no representation regarding the trademark status of the Domain in any jurisdiction.
Buyer's contact information will be shared with the relevant domain registrar as required for the transfer process. Domainster will not share Buyer's information with other third parties except as required by law or as described in Domainster's Privacy Policy.
To the maximum extent permitted by law, Domainster's total liability arising out of or related to this Agreement shall not exceed the amount actually paid by Buyer for the Domain. In no event shall Domainster be liable for indirect, incidental, consequential, special, or punitive damages.
This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, United States of America, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved through binding arbitration in Indianapolis, Indiana.
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the Parties.
